1. Scope & Definitions
1.1 These GTC apply to all orders placed via www.vapstore.at by consumers (private end-users) and businesses (commercial entities).
1.2 Conflicting terms from customers are invalid unless expressly agreed in writing.
1.3 Contracts are concluded in German or English, depending on the shop language used during ordering.
2. Contract Formation
2.1 Our online offers are non-binding. A contract is formed only when:
- You submit a binding order, and
- We accept it via email confirmation within 3 business days or by dispatching goods.
2.2 Order confirmations are sent immediately; these are not contract acceptances.
2.3 Consumers may cancel orders under our Right of Withdrawal (Section 3).
3. Right of Withdrawal & Returns
3.1 14-Day Withdrawal Period:
- Starts upon receipt of the last item in your order.
- Notify us via email/post (contact details below) or use the model cancellation form.
3.2 Exceptions: Non-returnable items include: - Custom-made or perishable goods.
- Sealed products (hygiene/health reasons).
- Goods with broken tax stamps.
3.3 Return Process: - We cover return shipping costs.
- Refunds issued within 14 days of receipt of returned goods.
- Original payment method used (no fees).

4. Prices & Payment
4.1 Prices include German VAT (excl. shipping). International customers may incur customs fees.
4.2 Payment Methods:
- PayPal: Buyer protection included (currently restricted for vaping products).
- Invoice (BILLSAFE): 14-day payment term (credit check required).
- Bank Transfer: International transfers must cover full amount (fees borne by buyer).
- Credit Card (Visa/Mastercard): Charged immediately.
- SOFORT Überweisung: Instant bank transfer (EU only).
5. Shipping & Delivery
5.1 Shipping Partners: DHL (Germany) / DHL International.
5.2 Delivery Times:
- Germany: 1–3 business days after dispatch.
- International: Varies by destination.
5.3 Risk Transfer: - Consumers: Upon delivery.
- Businesses: Upon handover to carrier.
6. Warranty & Defects
6.1 Statutory Warranty:
- Consumers: 2 years.
- Businesses: 12 months (must report defects within 5 days of delivery).
6.2 Process: Request repair/replacement first. If unresolved, you may demand a refund, price reduction, or compensation.
6.3 Transport Damage: Notify carrier and us immediately.
7. Retention of Title
Goods remain our property until full payment is received. Resale prohibited without written consent.
8. Dispute Resolution
8.1 EU consumers may use the ODR Platform.
8.2 For Germany: Disputes may be resolved via the Federal Universal Arbitration Board (www.universalschlichtungsstelle.de).
9. Governing Law & Jurisdiction
9.1 German law applies (excluding CISG).
9.2 For businesses: Exclusive jurisdiction in Karlsruhe, Germany.
